By signing up and actively using the DealBarbiePays program you agree to all terms and conditions set forth in this agreement. DealBarbiePays may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with DealBarbiePays. If any modification is unacceptable to you, your only recourse is to terminate this agreement or to file an appeal. Your continued participation in the DealBarbiePays program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.
Relationship of the Parties
You and DealBarbiePays are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and DealBarbiePays. You understand that you do not have authority to make or accept any offers or make any representations on behalf of DealBarbiePays. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the DealBarbiePays program. For privacy and for protection of our marketing strategies no part of the site, emails, newsletters, updates, templates and promotions may be reproduced in any way without prior consent. This includes but it not limited to use of our images, ideas, text, terms or any other information we consider as copyrighted material. Publishing/posting/quoting part or all of such content online or offline by any means or method is prohibited.
Limitation of Liability
DealBarbiePays will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or DealBarbiePays program, even if DealBarbiePays has been advised of the possibility of such damages. Furthermore, DealBarbiePays aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. Multiple signups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud.
Spam
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with DealBarbiePays and may result in legal prosecution. DealBarbiePays strictly enforces anti-spamming laws. Spamming is a federal crime. Any member caught spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. DealBarbiePays may charge up to $5 per Spam email sent. Multiple signups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. DealBarbiePays will file charges for recovery of any earnings received from multiple signups.
Privacy Policy
At DealBarbiePays, we strive to develop innovative services to better serve our users. We recognize that privacy is an important issue, so we design and operate our services with the protection of your privacy in mind. This Privacy Policy outlines the types of personal information we gather when you use DealBarbiePays's services, as well as some of the steps we take to safeguard it.
The following principles apply to the personally identifying information we ask for and that you provide. "Personally identifying information" is information that individually identifies you, such as your name, physical address or email address.
Privacy Policy - Ownership
DealBarbiePays will never be sold to a new owner. If DealBarbiePays were ever to close a 30 day notice would be sent out via email (to subscribed members), an inbox message, a forum post, as well as being posted on the main page of the site. All outstanding ads will be refunded for the amount remaining. The minimum cashout amount would be lowered to .01 (1 cent) so all members may request their full account balance for payment. However, the $5 signup bonus may only be cashed out in withdrawals of $20 or more.
Advertising
Advertising is a service offered to active members. Meaning a members must have completed a PTS offer that is not in the advertiser category within the last 30 days. Additionally, the ad may not be for a non-incentive offer, contain illegal content, contain adult content, or for a site on the banned advertiser list found here. Additionally, you may not use your $5 Signup Bonus to purchase advertising. Doing so will result in automatic account deletion.
Data Collection
DealBarbiePays collects limited non-personally identifying information your browser makes available whenever you visit a website. This log information includes your Internet Protocol address, browser type, the date and time of your access and one or more cookies that may uniquely identify your browser. We use this information to operate, develop and improve our services.
Some of our services require you to register for an account. DealBarbiePays asks you for some personal information in order to create an account (typically your name, email address, e-gold account and a password for your account) and we will use that information to provide the service. For certain services, such as our advertising programs, we may request credit card or other payment information, which we maintain in encrypted form on our server.
Cookies
Upon your first visit to DealBarbiePays, a cookie is sent to your computer that uniquely identifies your browser. A "cookie" is a small file containing a string of characters that is sent to your computer when you visit a website.
We use cookies to improve the quality of our service and to better understand how people interact with us. DealBarbiePays does this by storing user preferences in cookies and by tracking user trends and patterns of how people access our site.
Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some DealBarbiePays features or services may not function properly without cookies.
Information Sharing
We will not sell, disclose or lease any personal information to any other entity, unless this information is required by a local Law Enforcement Agency's.
Fraud
Using fraudulent information to complete offers and/or completing offers with fraudulent intent will result in the member's account being deleted without notice and without pay. Fraud includes, but is not limited to: using stolen credit cards to complete offers; using fake information to complete offers; using information that is not their own to complete offers; using pre-paid gift and/or credit cards to complete offers that are not in your name or information; completing offers more than once; canceling offers and/or trials immediately; having more than one account per household.
While we do not share your personal information as a member of DealBarbiePays. If you are caught frauding or cheating DealBarbiePays and your account is terminated by DealBarbiePays for those reasons your username, IP, and offers completed are NOT considered personal information, and will be shared with other site owners and/or advertisers at their request. In addition, publicly slandering DealBarbiePays if found to be fraudulent can result in legal action for slander and/or the fraudulent proof to be posted publicly for all to view.
Fraud - DealBarbie Network
If you are found to be frauding a DealBarbie Network site you will not be allowed on any DealBarbie Network sites in the future.
Payments
Payments are sent Net 35. Example- If you request a payment in March your payment will be completed by May 5th. DealBarbiePays.com does not payout to members who are outside of the USA. If requesting payment via Paypal your paypal address must be verified. In addition, members with incomplete or inaccurate account information will not be paid. If necessary, payments may require additional time in order to be processed. Offers that the member completed in the past month may not always be confirmed the month after, as some offers take longer to receive commissions on. All DealBarbiePays.com members understand and acknowledge that no payment shall be made until DealBarbiePays.com has received payment from its advertisers. Before payment is made, every account on DealBarbiePays.com is audited to ensure that no fraud has taken place. DealBarbiePays.com will never be deemed as owing payment to any member. Payment will only be made after verification that the offers they completed have been validated and paid upon. DealBarbiePays.com reserves the right to request ID verification for any and all accounts. This request may be made without stated cause. If this request is denied, DealBarbiePays.com reserves the right to withhold funds.
Non-Liable
DealBarbiePays.com shall, at no time, be held liable for any result of the use of the member's account. This includes, but is not limited to: termination, suspension, information dissemination, legal proceedings against you, damages (actual or consequential), suits, losses, judgments, litigation costs, attorneys' fees, and any other consequences. Any and all consequences of decisions the member makes on any website listed in 'offers' will be the sole responsibility of that member. DealBarbiePays.com will not be held responsible for any and all actions performed on any and all advertisers websites and/or with their products and services.
Non-Commitment
DealBarbiePays.com has no commitment toward any of their users and/or members. DealBarbiePays.com shall, at its discretion, terminate the service for any and/or all users and/or members at any time, without any notice. Upon termination, DealBarbiePays.com does not have any commitment toward any user/member whether past or present.
Termination
Termination of a member's account does not merit the creation of a new account. There is only one account per household allowed. If more than one account is created in the same household, this is considered fraud and both accounts will be deleted with all monies forfeited. Members may cancel the use of DealBarbiePays.com at any time by emailing DealBarbiePays@yahoo.com and requesting account termination. In addition, members who are inactive for 6 months or longer will have their account removed. DealBarbiePays.com may, for any reason, at any time, without prior notice or warning, terminate any account. These terminated accounts shall lose any and all potential benefits associated with the site, including, but not limited to cash earned and prizes requested. DealBarbiePays.com will not offer or owe anything to users whose accounts have been terminated and/or suspended. DealBarbiePays.com reserves the right to terminate the account and withhold payment from any and all members that are deemed to be fraudulently completing offers, no matter how significant the degree of fraud.
Changes to this Policy
Please note the Terms of Service will change from time to time. We expect most such changes to be minor, but there may be changes that are more significant. Regardless, we will post those changes on this page and, if the changes are significant, we will also provide a more prominent notice via the inbox & posted on the news page.
